This policy governs the use of the Learning Management System of the National Maritime Polytechnic (NMP LMS).

The Learning Management System of the National Maritime Polytechnic (“NMP LMS”) is provided by the PCI Innovation Tech Center, Inc. and its affiliated companies (“PCI”).
These Terms and Conditions (“Terms”) govern your use of the NMP LMS, including the content, and other products and services contained in the NMP LMS (“Services”). Please read these Terms carefully and contact us if you have any questions, clarifications, or complaints.
By using our Services, you agree to be bound by these Terms, including
the policies reference in these Terms.
Using NMP LMS
Who may use our Services?
You may use our Services if you are already enrolled with a training course or program offered by the National Maritime Polytechnic (“NMP”) as complied with its enrolment requirements. You will be given you unique credentials which you will be used for accessing the course content.
You are prohibited to use another account or to have more than one account. If in case, you must report this to the site admin to integrate your account. Failure to report and doing it deliberately may result to disciplinary action by NMP.
Your license of use
Subject to these Terms, NMP and PCI grants you limited, personal, non-exclusive, non-transferrable, and revocable license to use our Services. You may download some of the content from our Services only for personal and non-commercial use. Using our Services does not give you ownership of or any intellectual property rights in our Services.
Feedback
We welcome your suggestions, ideas, comments, and other feedback regarding the Services. By submitting any Feedback, you grant us the right to use the Feedback without any restriction or any compensation to you.
Security
NMP and PCI care about the security of our users. While we work together to protect the security of NMP LMS and your account, we cannot guarantee that unauthorized third parties will not be able to defeat our security measures. Please notify us immediately of any compromise or unauthorized use of your account by emailing pci.informations@gmail.com.
Limitation of Liability
To the maximum extent permitted by law, PCI and NMP, its officers, directors, employees, agents and licensors do not accept any liability for any loss, damage, claim liability, expense or costs that may result from any transmission of such Malicious Software thru the NMP LMS.
PCI does not guarantee the validity and reliability of content provided by NMP in the NMP LMS.
Governing Law and Venue
You agree that these Terms will be governed by the laws of the Republic of the Philippines. In the event of any dispute related to this Terms, the court of jurisdiction will be in the regional trial court in the City of Manila.

- Register for only one account. Your account is linked to your email address. If you register on our site with more than one email address, you are registering for more than one account. If you have already registered for two accounts, contact the NMP site administrator or PCI’s eLearning Support (email: pci.informations@gmail.com).
- Your submissions to the training course requirements including assignments and quizzes must be your own work except when the task explicitly requires or permits collaboration.
- You may not share your solutions to homework, quizzes, or exams with anyone else unless explicitly permitted by the instructor. This includes anything written by you, as well as any official solutions provided by the course staff.
- You may not engage in any other activities that will dishonestly improve your results or dishonestly improve or damage the results of others.

PRIVACY DECLARATION
Data privacy under Republic Act No. 10173 encompasses the rights of individuals and obligations of organizations with respect to the collection, storage, use, share, disclosure, retention, and disposal of personal data in adherence to the principles of transparency, legitimate purpose and proportionality.
AFFIRMATION OF CONSENT
Upon my enrolment with National Maritime Polytechnic and in consonance with the Declaration of Data Privacy as afore-stated, I do hereby voluntarily gives my consent without force, violence, intimidation, or any acts or circumstances which vitiates my consent, to National Maritime Polytechnic to collect, use, store, update or modify, process, disclose or share my personal data such as but not limited to the following sensitive personal information – name, age, date of birth, civil status, religion, address, contact numbers and other contact information, records or documents, as requested or required by its proper authorities, subsidiaries or affiliates.
Likewise, I hereby gives consent to National Maritime Polytechnic to have my photographs taken at any time, during or after enrolment and further gives consent to the use or share of my photographs with its officers and/or personnel for newsletter, email communications, marketing and/or website publications, newspaper or television, and for any other legitimate purpose and intent of the institution.

CANCELLATION/REFUND POLICY:
1. If cancelled before the start of the training, a 20% cancellation fee based on the Published Rate will be charged to the trainee.
2. If cancelled on the training day, NO REFUND will be made. However, the trainee has the option to: a) re schedule; or b) change course, provided that either options shall be exercised by the trainee within one (1) year only from enrolment date. In the event the trainee chooses option (b), and if the new training course chosen is higher than the old course enrolled, he/she shall PAY THE DIFFERENCE. If the new course is cheaper than the old course, the trainee shall NOT BE REFUNDED thereof.
